Terms of Service

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and Gopher Tech LLC, a Wyoming limited liability company (“Company,” “we,” “us,” or “our”), with its registered address at 30 N Gould St, Ste R, Sheridan, WY 82801, United States. These Terms govern your access to and use of the SIGINT.WORLD website located at sigint.world (the “Site”), the SIGINT.WORLD mixed reality application (the “Application”), and all related services, features, content, and functionality (collectively, the “Services”).

BY ACCESSING OR USING THE SERVICES, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT ACCESS OR USE THE SERVICES.

1. Eligibility

You must be at least 13 years of age to use the Services. If you are between 13 and 18 years of age (or the age of legal majority in your jurisdiction), you may only use the Services with the consent of a parent or legal guardian who agrees to be bound by these Terms. By using the Services, you represent and warrant that you meet these eligibility requirements.

2. Account Registration

Certain features of the Services may require you to provide information such as an email address. You agree to provide accurate, current, and complete information and to update such information as necessary. You are solely responsible for maintaining the confidentiality of any credentials associated with your use of the Services and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use.

3. Pre-Orders and Payments

3.1 Pre-Order Program

The Services may offer pre-order opportunities for early access to the Application. Pre-orders are processed through Stripe, Inc., a third-party payment processor. By placing a pre-order, you agree to Stripe’s terms of service in addition to these Terms.

3.2 Pricing and Availability

All prices are listed in United States Dollars (USD) unless otherwise stated. We reserve the right to modify pricing at any time without prior notice. Pre-order pricing is locked at the time of purchase.

3.3 Refund Policy

Pre-orders are non-refundable except as required by applicable law. If the Application is not released within 24 months of your pre-order date, you may request a refund by contacting us at legal@sigint.world. All refunds, where applicable, are subject to a non-refundable processing fee of 5% of the original purchase price (minimum $1.00 USD) to cover third-party payment processing costs. Refunds will be processed within 30 business days to the original payment method.

3.4 Pre-Order Codes

Upon successful payment, you will receive a unique pre-order code. This code is personal, non-transferable, and may only be redeemed once. We are not responsible for lost, stolen, or shared codes.

4. License and Intellectual Property

4.1 Limited License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal, non-commercial use. This license does not include any right to: (a) modify or copy the Services or any content therein; (b) use the Services for any commercial purpose; (c) reverse engineer, decompile, or disassemble any software comprising the Services; (d) remove any proprietary notices; or (e) transfer your rights to any other person.

4.2 Ownership

The Services, including all content, features, functionality, software, code, graphics, logos, trademarks, trade names, and other intellectual property (collectively, “Company IP”), are owned by Gopher Tech LLC or its licensors and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws. “SIGINT.WORLD,” the SIGINT.WORLD logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Gopher Tech LLC.

5. User Conduct

You agree not to:

• Use the Services for any unlawful purpose or in violation of any applicable law or regulation;
• Use the Services to harass, threaten, stalk, or intimidate any person;
• Attempt to gain unauthorized access to any part of the Services, other accounts, computer systems, or networks connected to the Services;
• Use any automated means (bots, scrapers, crawlers) to access or collect data from the Services;
• Transmit any viruses, worms, malware, or other harmful code;
• Interfere with or disrupt the integrity or performance of the Services;
• Impersonate any person or entity or misrepresent your affiliation with any person or entity;
• Exploit, cheat, hack, or use any unauthorized third-party tools to gain an unfair advantage in the Application;
• Engage in real-world trespassing, unsafe behavior, or any activity that endangers yourself or others while using the Application’s location-based features;
• Use the Application while operating a motor vehicle or in any situation where use could be dangerous;
• Access restricted, private, or government property while using the Application.

6. Location-Based Features and Safety

6.1 GPS and Location Data

The Application uses GPS and location data to provide location-based mixed reality experiences. By using the Application, you consent to the collection and use of your location data as described in our Privacy Policy.

6.2 Safety Disclaimer

YOU ARE SOLELY RESPONSIBLE FOR YOUR SAFETY AND AWARENESS OF YOUR PHYSICAL SURROUNDINGS WHILE USING THE APPLICATION. The Application overlays digital content onto your real-world environment. You must maintain awareness of your surroundings at all times. Do not use the Application in any location or manner that could result in injury, property damage, or trespass. We are not responsible for any injuries, damages, or legal consequences arising from your use of the Application in the real world.

6.3 Property Rights

The Application’s use of satellite imagery, terrain data, and building data does not grant you any right to access private property. You must comply with all applicable trespass and property laws.

7. Mixed Reality and Health Warnings

The Application is designed for use with Meta Quest mixed reality headsets. Use of virtual and mixed reality devices may cause motion sickness, disorientation, eye strain, seizures, or other adverse health effects in some individuals. If you experience any discomfort, discontinue use immediately. Consult a physician before use if you have a history of seizures, epilepsy, or other neurological conditions. We are not liable for any health effects resulting from use of the Application or compatible hardware.

8. User-Generated Content

If the Services permit you to submit, post, or transmit content (“User Content”), you retain ownership of your User Content but grant Gopher Tech LLC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, display, and perform your User Content in connection with the Services. You represent and warrant that you own or have the necessary rights to your User Content and that it does not violate any third-party rights or applicable laws.

9. Third-Party Services

The Services may contain links to or integrations with third-party websites, services, or applications (including Stripe for payments, Mailchimp for communications, and Meta for hardware). We do not endorse, control, or assume responsibility for any third-party services. Your use of third-party services is governed by their respective terms and privacy policies.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE MAKE NO WARRANTY REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT OR INFORMATION PROVIDED THROUGH THE SERVICES, INCLUDING LOCATION DATA, TERRAIN DATA, OR BUILDING DATA.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GOPHER TECH LLC, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE), EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).

12. Indemnification

You agree to indemnify, defend, and hold harmless Gopher Tech LLC and its members, managers, officers, employees, agents, affiliates, and licensors from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including any intellectual property, property, or privacy right; (d) your User Content; or (e) any injury, property damage, or other harm arising from your use of the Application in the real world.

13. Dispute Resolution and Arbitration

13.1 Informal Resolution

Before initiating any formal dispute resolution, you agree to first contact us at legal@sigint.world and attempt to resolve the dispute informally for at least 30 days.

13.2 Binding Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Services that cannot be resolved informally shall be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. The arbitration shall be conducted in Sheridan County, Wyoming, or at another mutually agreed location. The arbitrator’s decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

13.3 Class Action Waiver

YOU AND GOPHER TECH LLC AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of class or representative proceeding.

13.4 Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement or misappropriation of intellectual property rights.

14. Governing Law

These Terms and any dispute arising out of or related to them shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. To the extent that arbitration does not apply, you consent to the exclusive jurisdiction and venue of the state and federal courts located in Sheridan County, Wyoming.

15. Termination

We may terminate or suspend your access to the Services at any time, with or without cause, with or without notice, effective immediately. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnification, limitations of liability, and dispute resolution provisions.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by updating the “Effective Date” at the top of this page and, where practicable, by sending notice to the email address associated with your account. Your continued use of the Services after such modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Services.

17. Modifications to Services

We reserve the right to modify, suspend, or discontinue the Services (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services. The Application is currently in development; features, content, and availability are subject to change.

18. Electronic Communications

By providing your email address and using the Services, you consent to receive electronic communications from us, including marketing emails, transactional emails, and notices. You may opt out of marketing communications at any time by using the unsubscribe link in any email. Opting out of marketing communications does not affect transactional or legal notices.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

20. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Gopher Tech LLC regarding the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

21. Waiver

No waiver by Gopher Tech LLC of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

22. Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. These Terms are binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.

23. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, pandemic, government actions, power failures, internet or telecommunications failures, or third-party service disruptions.

24. Export Compliance

You agree to comply with all applicable export and re-export control laws and regulations, including the Export Administration Regulations maintained by the U.S. Department of Commerce and sanctions programs maintained by the U.S. Treasury Department’s Office of Foreign Assets Control (OFAC).

25. Trademark Notices

Meta, Meta Quest, and the Meta logo are trademarks or registered trademarks of Meta Platforms, Inc. Steam and the Steam logo are trademarks or registered trademarks of Valve Corporation. All other trademarks, service marks, trade names, and logos referenced herein are the property of their respective owners. The use of any third-party trademarks on this Site or in connection with the Services does not constitute or imply endorsement, sponsorship, or recommendation by the trademark owner, nor does it constitute or imply endorsement, sponsorship, or recommendation of the trademark owner by Gopher Tech LLC.
